These Terms and Conditions (the “Terms”) govern your access to and use of the website, online forms, communications, and related digital services operated by ServiceMaster Restoration by Wise (“ServiceMaster by Wise,” “we,” “us,” or “our”). These Terms also contain the terms governing our text messaging program.
By accessing or using our website, submitting a form, requesting services, or otherwise interacting with our digital services, you agree to these Terms. If you do not agree, do not use our website or digital services.

2. Restoration Services
ServiceMaster by Wise provides construction, restoration, cleanup, mitigation, and related services. Information made available through our website or communications is provided for general informational purposes and does not constitute a binding estimate, guarantee, professional opinion, insurance determination, or agreement to perform services.
Specific services, prices, schedules, warranties, payment obligations, and other project terms may be governed by a separate written estimate, work authorization, service agreement, change order, invoice, or other project document. If a conflict exists between these Terms and a signed project-specific agreement, the signed project-specific agreement controls with respect to that project.
3. Emergency Requests and Availability
Submitting a website form, voicemail, email, or text message does not guarantee that we have received or accepted an emergency service request. Response times and service availability may be affected by location, weather, demand, safety conditions, staffing, access, and circumstances beyond our reasonable control.
If there is an immediate threat to life, health, or safety—including fire, suspected gas leaks, structural collapse, electrical hazards, or a medical emergency—call 911 or the appropriate emergency authority first. Do not rely on our website, email, or text messaging service for emergency dispatch.
4. Estimates, Inspections, and Insurance
Any preliminary price, timeframe, scope, or assessment provided before an on-site inspection is an estimate only and may change after inspection, testing, demolition, discovery of concealed conditions, changes in material or labor costs, or changes requested or required during the work.
We may communicate with insurers, adjusters, property managers, mortgage companies, subcontractors, consultants, or other parties when authorized or reasonably necessary to evaluate or perform requested services. We do not guarantee insurance coverage, claim approval, reimbursement, settlement amount, or payment by any insurer or third party. Unless a written agreement expressly states otherwise, the customer remains responsible for charges incurred for requested or authorized services.
5. Eligibility and Acceptable Use
You must be at least 18 years old and legally capable of entering into a binding agreement to request services or submit information on behalf of a property owner, tenant, business, or other person. If you act for another person or organization, you represent that you have authority to do so.
You agree not to:
use the website or digital services for unlawful, fraudulent, abusive, or misleading purposes;
submit false contact, property, insurance, or payment information;
interfere with the security, availability, or operation of the website;
introduce malware or attempt unauthorized access to any system or account;
copy, scrape, reproduce, or exploit website content except as permitted by law; or
impersonate another person or misrepresent your authority.
6. User Submissions
When you submit information, messages, photographs, videos, documents, measurements, descriptions of property damage, or other materials, you represent that the submission is accurate to the best of your knowledge and that you have the right to provide it.
You authorize us to use, reproduce, review, transmit, and share submitted materials as reasonably necessary to respond to your request, prepare an estimate, coordinate services, document work, communicate with authorized parties, administer a claim, comply with law, or protect legal rights. Our collection and use of personal information is also governed by our Privacy Policy.
7. Electronic Communications and Signatures
You consent to receive records, notices, estimates, invoices, agreements, and other communications electronically when you provide an email address or otherwise choose electronic delivery. Electronic signatures and acknowledgments may have the same legal effect as handwritten signatures where permitted by law. You are responsible for maintaining accurate contact information and access to your email and mobile accounts.
8. SMS/MMS Messaging Terms
8.1 Program Description
When you expressly opt in to receive text messages from ServiceMaster Restoration by Wise, we may send SMS or MMS messages concerning your inquiry or relationship with us. Messages may include:
responses to inquiries and requests for service;
appointment, inspection, technician, and scheduling updates;
estimates, authorizations, project-status, documentation, and completion updates;
billing, payment, customer-service, and account-related notices;
requests for information, feedback, or reviews; and
promotional offers, reminders, or marketing messages, but only where permitted by law and consistent with the consent you provided.

8.2 Consent Is Optional
Your consent to receive automated or marketing text messages is not a condition of purchasing any property, goods, or services. You may request services by calling us at (248) 284-1200 if you do not wish to consent to text messaging.
8.3 Message Frequency and Charges
Message frequency varies based on your requests, project activity, and interactions with us. Message and data rates may apply. Your mobile carrier’s message, data, and other rates and terms govern your mobile service.
8.4 Opting Out
You may opt out at any time by replying STOP to any message from us. We may send one non-promotional text confirming that your opt-out request was received. After opting out, you will no longer receive texts from that messaging program unless you later provide new consent.
We will treat other reasonable statements indicating that you want messages to stop as an opt-out request where required by applicable law. Opting out of text messages does not prevent us from contacting you through other lawful methods when necessary to administer an existing service, contract, account, payment, or legal obligation.

8.6 Supported Carriers and Delivery
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless provider and is outside our control. Not all mobile devices or carriers may be supported.
8.7 Mobile Number Responsibilities
You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to messages at that number. If your number changes, is reassigned, or is no longer used by you, you agree to notify us promptly at info@smbywise.com or (248) 284-1200.
8.8 Privacy of SMS Consent Data
We do not sell or share mobile phone numbers, SMS opt-in data, or text-message consent information with third parties or affiliates for their own marketing or promotional purposes. We may disclose information to service providers that help us operate our messaging program, but only as necessary for them to provide services on our behalf and subject to appropriate confidentiality and use restrictions. Text messaging originator opt-in data and consent will not be shared with any third parties for their own marketing purposes.
8.9 Modification or Termination
We may modify, suspend, or discontinue all or part of the messaging program at any time. Any change will not affect your right to opt out. These SMS/MMS Messaging Terms are part of these Terms and should be read together with our Privacy Policy.
9. Email Communications
If you receive promotional email from us, you may unsubscribe using the link or instructions in the message. We may continue sending non-promotional communications relating to active requests, projects, transactions, accounts, safety issues, or legal obligations where permitted by law.
10. Intellectual Property
The website and its text, graphics, photographs, videos, designs, software, logos, service marks, and other content are owned by or licensed to ServiceMaster by Wise or their respective owners and are protected by intellectual-property laws. ServiceMaster names, marks, and branding may be owned by or licensed from their respective trademark owners. Nothing in these Terms grants you ownership of or a license to use any trademark, logo, or proprietary content except for personal, noncommercial viewing of the website.
11. Third-Party Services and Links
Our website or communications may contain links to third-party websites, payment processors, insurers, mapping services, review platforms, social networks, or other services. We do not control and are not responsible for third-party content, security, availability, privacy practices, or terms. Your use of a third-party service is governed by that provider’s policies.
12. Website Availability and Disclaimer
We make reasonable efforts to provide accurate and useful information, but the website and digital services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties relating to the website and digital services, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the website will always be uninterrupted, secure, error-free, current, or free of harmful components. This disclaimer does not eliminate warranties or obligations that cannot lawfully be excluded or any express warranty contained in a separate signed agreement.
13. Limitation of Liability
To the fullest extent permitted by applicable law, ServiceMaster by Wise and its owners, officers, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website, digital services, or your reliance on general website content.
For claims arising solely from use of the website or digital services, our aggregate liability will not exceed the greater of the amount you paid specifically to access the website or $100. This limitation does not apply where prohibited by law and does not replace any liability terms in a separate signed service agreement.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless ServiceMaster by Wise and its owners, officers, employees, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the website, your material violation of these Terms, or information or materials you submit without authorization.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any court proceeding arising solely from these Terms or use of the website must be brought in a court of competent jurisdiction located in Macomb County, Michigan, unless applicable law requires otherwise. This section does not alter dispute-resolution provisions in a separate signed service agreement.
16. Changes to These Terms
We may update these Terms from time to time. The revised version will be posted with a new “Last Updated” date. Changes apply prospectively when posted unless a later date is stated. Material changes to the SMS/MMS Messaging Terms will apply in accordance with applicable law.
17. Severability and Waiver
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
18. Entire Agreement
These Terms and the Privacy Policy constitute the agreement governing your use of the website and digital services. They do not replace any separate estimate, work authorization, service contract, payment agreement, warranty, or other project-specific document.
